Terms and Conditions

1. Program Overview

DriveDefensivelyTexas.com (“Company,” “we,” “our”) offers an Affiliate Program (“Program”) that allows individuals and organizations (“Affiliate,” “you”) to earn commissions by referring customers to our Texas Department of Licensing and Regulation (TDLR)-approved defensive driving course. By enrolling in the Program, you agree to be bound by these Terms and Conditions (“Agreement”).

2. Eligibility

To participate, you must:

• Be a legal resident of the United States;
• Be at least 18 years of age; and
• Operate a legitimate platform (e.g., website, blog, or social media account) that complies with all applicable laws and ethical marketing practices.

We reserve the right to approve or reject any application for any reason, at our sole discretion.

3. Commission Structure

You will earn a commission of 20% of the tuition fee (excluding taxes, refunds, and chargebacks) for each sale made through your unique affiliate link. Payments are issued 30 days after a completed sale, provided no refund or dispute is pending. A minimum payout threshold of $50 applies. Payments are made via PayPal, check, or direct deposit, as specified in your account settings. We reserve the right to adjust the commission rate or payment schedule with written notice.

4. Marketing Guidelines and FTC Compliance

You must promote our courses truthfully, without false, misleading, or deceptive claims. Affiliates are strictly prohibited from:

• Misrepresenting themselves as Drive Defensively Texas or implying any employment or agency relationship;
• Using spam, unsolicited messages, or deceptive traffic methods;
• Making false or misleading claims about TDLR certification or course benefits.

FTC Disclosure Requirement: Affiliates must clearly and conspicuously disclose their relationship with Drive Defensively Texas in all promotional materials (e.g., “As an affiliate, I may earn a commission from qualifying purchases.”) Failure to comply may result in immediate termination and forfeiture of commissions.

5. Use of Intellectual Property

You are granted a limited, non-exclusive, revocable license to use DriveDefensivelyTexas.com marketing materials solely for promotion under this Program. You may not modify, misrepresent, or register any trademarks, URLs, or domain names containing “Drive Defensively Texas” or similar marks.

6. Tracking and Attribution

Sales are tracked through your unique affiliate link and/or referral code. Only transactions recorded through our tracking system will be eligible for commission. We are not responsible for any tracking errors due to ad blockers, user device settings, or technical issues beyond our control.

7. Termination

Either party may terminate this Agreement at any time, with or without cause, by providing written notice. Upon termination, you must immediately remove all promotional materials and links, and any unpaid commissions for valid completed sales will be paid in the next cycle.

8. Limitation of Liability

To the fullest extent permitted by Texas law, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of this Program. Our total liability shall not exceed the total commissions paid to you during the three (1) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless DriveDefensivelyTexas.com, its owners, and affiliates from any claims, damages, or expenses arising from your breach of this Agreement or your promotional activities.

10. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute shall be resolved in mediation or the state or federal courts located in Bexar County, Texas, and both parties consent to such jurisdiction.

11. Amendments

We may modify this Agreement at any time by posting an updated version on our website. Your continued participation in the Program after such changes constitutes your acceptance of the revised terms.
